A Stay Above The Rest, LLC
SHORT TERM RENTAL AGREEMENT
This Short Term Rental Agreement (the “Agreement”) is made by and between A Stay Above the Rest LLC (“ASATR”) and _____________________ (“Guest”)* as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:
Guest. The term “Guest” shall include Guests, Invitees, their successors, heirs, agents and assigns including any minors.
Property. The property (“Property”) is located at:

The property is furnished and includes such items as: fridge/freezer, stove/oven/microwave, cooking utensils and equipment, bed sheets, bath towels, beach towels where necessary, essential cooking spices, baking and cooking supplies. [this is not a comprehensive list.]
Rental Party: The rental party shall consist of Guest and not exceed the maximum number of occupancy allowed.

Maximum Occupancy: Maximum number of guests is listed on each property listing site.
Minors and Legally Incapacitated Guests: Minors are defined as anyone under the age of 18. Anyone under the age of 18 or legally incapacitated must have a guardian sign and take full responsibility for any and all damages and/or penalties. In the sole discretion of ASATR, the guardian also be required to make an additional security deposit.
Term of the Lease. The lease begins at 4:00 p.m. on ___________, 20__ (the “Check-in Date”) and ends at 11:00 a.m. on _________, 20__ (the “Checkout Date”). If the Property appears dirty or damaged upon Check-in, Guest shall inform Manager immediately.
Minimum Stay: Minimum stay is listed on each booking site according to the appropriate season, date, weekend, etc.
Rental Rules: Guest agrees to abide by the Rental Rules attached as Exhibit A at all times while at the Property and shall cause all members of the rental party and anyone else Guest permits on the Property to abide by the following rules at all times while at the Property. Guest is responsible for any damage or costs caused by the negligence or intentional acts of all persons who Guest permits to be on the Property. If Guest does not abide by any of the rental rules, the Guest stay may be terminated with no refund as well as any fines and or fees associated.
Access: Guest shall allow Manager access to the Property for purposes of repair and inspection. Manager shall exercise this right of access in a reasonable manner.
Rental Rate and Fees; Damages
Deposit: No security deposit is required unless otherwise stated by booking agent/site. However, payment for the rental stay must be paid in advance
Fireplace (if applicable): Failure to properly clean ashes from the fireplace, if used, will result in a $50 charge
Fire-pit (if applicable): Failure to properly clean ashes from the fire-pit, if used, will result in a $50 charge
BBQ Grill (if applicable): Failure to properly clean the BBQ grill, if used, will result in a $50 charge
Charge for Damages: Manager shall communicate all claims of damage to Guest within 14 days after the Checkout Date for the following:
Damage to the property
dirt or other mess requiring excessive cleaning;
failure to adhere to the rental rules outlined in exhibit A; or
any other cost incurred by Manager or the Owner due to Guest’s stay.
Rental Rate. Rental rates will be communicated via booking site. Payment in full shall be due according to time frame specified by booking site.
*Cancellation Policy: If Guest wishes to cancel his/her reservation, the prepaid rental will be refunded as follows:
100% (minus cancellation fee) if canceled more than thirty (30) days prior to Check-in Date
0% if canceled fewer than 30 days prior to the Check-in Date
If rates fluctuate, both owner and guest will abide by rates agreed upon in this contract.
Cancellation Fee: $150 for standard reservations ; $200 for standard reservations that are defined as peak season.
Peak season dates include, but not limited to, the following large events such as, but not limited to, SXSW, ACL, Lone Star Rally, Formula One; Holidays such as Memorial Day, Easter, Fourth of July, Labor Day, Thanksgiving, Christmas, New Year’s Eve; or Seasonal such as Spring Break, Summer Dates (Memorial Day – Labor Day)
If Guest cancels on or after 30 days prior to Check-in Date, no rental fees (including the administrative fee) will be refunded

IN THE EVENT EVENTS BEYOND THE CONTROL OF THE LANDLORD INCLUDING BUT NOT LIMITED WEATHER SUCH AS HURRICANE, BLIZZARD, SNOWFALL OR FREEZING RAINS, EXCESSIVE RAINFALL, FLOODING OR DAMAGE OCCASIONED THEREBY MAKING EITHER ACCESS TO OR OCCUPATION BY GUEST IMPOSSIBLE OR UNDESIRABLE, NO REFUNDS WILL BE MADE. GUESTS ARE ENCOURAGES TO SEEK TRAVELERS INSURANCE OR OTHER SECURITY.
12. Property Damage Protection: Terms and Conditions
Responsibility for Accommodation:
- As a Guest, you acknowledge and agree that you are responsible for maintaining the Accommodation in the condition it was in upon your arrival. You are liable for your own actions and those of any individuals you invite to or grant access to the Accommodation.
Property Damage Protection Coverage:
- You understand that any damage protection coverage, provided to you does not extend to wanton, malicious, or willful acts, and may not cover gross negligence. In the event of damages claimed by the Host due to such acts, you agree to reimburse the Host for the cost of replacing damaged items with equivalent ones.
Reporting Damages:
- In the event of damage to the Property, you must promptly report it to the property management company. Failure to report damages promptly may affect coverage under the Property Damage Protection plan.

Unit was clean and as pictured. Beautiful view, walking distance to so much. We ate at places all within walking distance. No problems getting into unit or buying the parking pass in the lobby. Would stay here again

My wife and I thoroughly enjoyed our mini vacation at this condo unit at Casa Del Mar. The unit was extremely comfortable, with a breathtaking view of the ocean, and only a few steps from the beach. The host ( A Stay Above The Rest) with its very responsive associates were just a phone call away and ready to help. We will definitely be back soon!

This little condo is PERFECT! It has everything will need for cooking and plenty of towels wash cloth's. The bed was so comfortable and very it was very quiet. One very small suggestion would be that the curtain in the bedroom be replaced with a block out curtain or ad a blind. The light from the hallway light's up the room at night.We would love to stay her again.

Incredible place. Clearly much thought was put into every detail and the place was exceptional. The location directly across from the beach and you could easily and safely cross at the light. The view from the apartment was incredible. The pools at the complex were lovely and the landscaping perfection. We loved everything about our stay and would happily stay again.

We went to Galveston to accompany my son to his prom and stayed here. It was just as described. There were six of us, and there was plenty of space. The beds were comfortable, and the condo was very clean and easy to find. The staff was very friendly. The view was gorgeous!! We were within walking distance of many places on the Seawall. I definitely recommend staying here. The whole process was easy and pleasant. A huge thank you to Melissa for all your help!!

Great spot. Very clean and everything was as described. Our room was a little cramp for 4 people but we knew that going into it. There is a $40 parking fee and some other fees that are not included in the VRBO total price quoted.

The location had a beyond beautiful view of the ocean. The sunrise was breathtaking. The room seems small but has absolutely everything you need. Clean and set up of the entire place and decor was outstanding.

Stayed at the property for a week during a conferences at the Galveston Island Convention Center and it was perfect! A quick walk each day, fast food and Kroger in between us and the convention center, and much more affordable than a lot of the hotels in the area while providing a lot more space. Best bang for your buck in the area by far!! Having K-cups provided for coffee was a plus as we had early starts in the morning!

I needed to relax and chill out for a few days, and this fit the bill exactly. I wouldn't hesitate to stay here again.
Obviously, the whole island isn't within walking distance, but enough was within walking distance that I didn't have a problem not having a car - Walmart is within walking distance, Kroger not much further. I stocked my fridge with basic foods and drink which helped the overall budget. A few good restaurants are a mile or less away, so they're walkable too. I got a rideshare drive to The Strand area one night and did some more walking there as well.
Overall, great experience... and I found management very accessible and willing to help me out with any issues that popped up - and they even answered questions about the area. Be sure to read the online guidebook first - it answers most common questions and makes helpful recommendations.

Was very impressed with the everything. For one, the company let us rebook after learning the passing of my sister.How kind is that!! The place was decorated so nice and super clean.. Ocean front view was amazing. Just a short walk across the street. Most impressing was how nice everyone there from front desk to the maintenance was.. would most definitely recommend this place!!!

The location of this place is great! Everything is nearby. The balcony gives you a great view of the ocean & great sunrises.
The location however is at a big intersection & traffic light. So it is quite noisy with all the traffic.
We were a couple… and I still found the place to be a bit too tight for my liking. Not enough table/ kitchen top space. I personally like more space. You may not need the space.
It had a musty smell when we entered. So we aired it out. I feel it was the couch … it probably needs to get professionally cleaned. The sheets & towels were nice and clean. The pits and pans however were not. There was a thick layer of dust on the frames. Didn’t like that since we are breathing the air in the space.
They also have a few of $ 20 for property damage which they do not refund if you haven’t damaged the property. I’ve never seen that charge on any rental I’ve ever done.
The customer service was amazing & the team was very prompt to answer any queries I had.

The property was amazing! Beautiful deco inside our unit with a warm, comfortable relaxing feel. The balcony facing directly over the beach gave us beautiful sunrises and sunsets.. The property was amazing and worth saying again. The landscape beautifully kept and the swimming pools were so inviting and enjoyable. Everything was clean and fresh and accommodated with everything we needed. The booking, the check in and check out was so easy. We definitely look forward to doing this again.

It was great as a home base during our youngest national dance competition. It was beautiful to be across the beach and it was perfect and easy ride to get to competition. The kitchenette was perfect for us cooking what our family needed and was just enough space for all of us to enjoy. Would definitely recommend.

Nicely decorated place. Location is very noisy sitting on balcony. The sleeper sofa is terrible and the bunk beds are really small. I know it says sleeps six but that would only be if you have small children.

We always love staying at casa Del Mar and A Stay Above the Rest is great! Always willing to answer questions, property is always as it appears in photos, convenient to food, fun and entertainment. We will be back!

Would totally stay here again and have already saved them for my next trip to Galveston! I can't see myself staying anywhere else! Absolutely no complaints as the place was perfectly clean and comfortable and definitely is a stay above the rest!

We didn't like all the road noise/traffic .... Sorry of ruined the morning coffee on the balcony idea, but oh well. It's cute, clean and centrally located.
The hair dryer was missing which led me to walking around town with a bad hair day, but oh well! LOL
They did deliver a replacement the next day -- at 8 am!!!! Being woken up early on vacay is 👎

Loved our stay! Unit was very clean and provided us all the amenities we needed. Beautiful views of the Gulf and easy access to the beach. Check in was flawless and there was ample parking. We had no complaints and would definitely recommend this place to anyone visiting Galveston.

Great stay. The unit was very clean and nicely decorated and equipped with supplies. The unit is small but makes great use of small space. Good size for one couple and small children. Loved the view, easy access to the beach, and the heated pool. Great location!

The condo was close to the beach and the pools were heated. It was a good quick trip for our family.

This property was perfect for a cozy beach getaway. It was super clean and had everything we needed (and more). I really appreciate that they even provided beach towels. The balcony and view were amazing. It was easy to get to the beach - just across the street with crosswalks. And lots of stores and restaurants close by and within walking distance. And all of that for a great price! Definitely would stay again.

The balcony looking over to the beach was excellent. The bathroom and kitchen fixtures needed more attention to cleanliness. We would be willing to go back for another stay!
